These PrecisionSec Maltego Transform Terms and Conditions (“Terms”) govern access to and use of PrecisionSec data, services, APIs, and related transform functionality made available through the Maltego platform (the “PrecisionSec Transforms”). By accessing or using the PrecisionSec Transforms, you agree to these Terms.
1. Parties
These Terms are between PrecisionSec Threat Management Solutions Inc. (“PrecisionSec”, “we”, “us”, or “our”) and the person or entity accessing or using the PrecisionSec Transforms (“Customer”, “you”, or “your”).
2. Scope of Service
The PrecisionSec Transforms provide access to certain threat intelligence data, enrichment data, metadata, and related information made available by PrecisionSec through Maltego.
Your use of the PrecisionSec Transforms is subject to:

any applicable agreement between you and Maltego

any applicable order form, subscription terms, or commercial terms governing your access to PrecisionSec data or services
PrecisionSec may update, improve, modify, suspend, or discontinue any portion of the PrecisionSec Transforms at any time.
3. Permitted Use
You may use the PrecisionSec Transforms only for your internal business purposes and only in accordance with applicable law.
You may use the PrecisionSec Transforms for lawful cybersecurity, threat intelligence, investigation, research, defensive, compliance, fraud prevention, or related security operations purposes.
4. Restrictions
You may not, and may not permit any third party to:

use the PrecisionSec Transforms for any unlawful purpose

use the PrecisionSec Transforms in violation of any privacy, data protection, export control, sanctions, or other applicable laws or regulations
-
resell, sublicense, redistribute, publish, transfer, or commercially exploit the PrecisionSec Transforms or underlying data except as expressly authorized in writing by PrecisionSec
-
copy, scrape, harvest, bulk extract, or systematically store PrecisionSec data except as reasonably necessary for your permitted internal use
-
reverse engineer, decompile, disassemble, or attempt to derive the source code, structure, or underlying methods of the PrecisionSec Transforms, except to the extent such restriction is prohibited by law

remove or alter any copyright, trademark, attribution, or proprietary notices
-
use the PrecisionSec Transforms to develop or support a competing commercial threat intelligence or data service
-
interfere with, disrupt, or attempt to gain unauthorized access to the PrecisionSec Transforms or related systems

use automated means to generate excessive or abusive query volume beyond the scope of your authorized use
5. Customer Responsibilities
You are responsible for:

ensuring that your use of the PrecisionSec Transforms complies with all applicable laws and regulations

maintaining the confidentiality of any credentials or access methods used in connection with the PrecisionSec Transforms
-
all activity conducted through your account, environment, or authorized users
-
independently reviewing and validating any data, output, enrichment, or other information before acting upon it in operational, legal, or business contexts
6. Data and Intelligence Disclaimer
Threat intelligence and related data are inherently probabilistic, time-sensitive, and subject to change. PrecisionSec does not guarantee that any data made available through the PrecisionSec Transforms is complete, accurate, current, error-free, or fit for any particular purpose.
Indicators, enrichments, classifications, reputational assessments, metadata, and related outputs may change over time and may contain inaccuracies, false positives, false negatives, omissions, or outdated information.
You are solely responsible for determining how to interpret and use any data obtained through the PrecisionSec Transforms.
7. No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PRECISIONSEC TRANSFORMS AND ALL RELATED DATA, CONTENT, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
PRECISIONSEC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RESULTS.
PRECISIONSEC DOES NOT WARRANT THAT THE PRECISIONSEC TRANSFORMS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRECISIONSEC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE PRECISIONSEC TRANSFORMS OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRECISIONSEC’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PRECISIONSEC TRANSFORMS OR THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU, IF ANY, FOR ACCESS TO THE APPLICABLE PRECISIONSEC TRANSFORMS DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
9. Intellectual Property
The PrecisionSec Transforms, and all related software, content, data compilations, methodologies, documentation, branding, and associated intellectual property, are owned by PrecisionSec or its licensors and are protected by applicable intellectual property laws.
Except for the limited right to use the PrecisionSec Transforms in accordance with these Terms, no rights are granted to you.
10. Confidentiality of Non-Public Access
If you receive any non-public access, credentials, documentation, or other materials relating to the PrecisionSec Transforms, you must keep them confidential and use them only for authorized purposes.
11. Suspension or Termination
PrecisionSec may suspend, restrict, or terminate access to the PrecisionSec Transforms at any time, with or without notice, if:

required by law
-
requested by Maltego under the applicable partnership arrangement
-
PrecisionSec reasonably believes you have violated these Terms
-
your use presents a security, legal, technical, or operational risk
-
payment or commercial authorization for your access is no longer in effect
Upon suspension or termination, your right to use the PrecisionSec Transforms will immediately cease.
12. Privacy and Data Handling
Use of the PrecisionSec Transforms may involve the transmission of query data, search terms, indicators, metadata, and related technical information necessary to process transform requests.
By using the PrecisionSec Transforms, you acknowledge and agree that PrecisionSec may process such data as necessary to provide, secure, maintain, support, analyze, and improve the PrecisionSec Transforms, subject to applicable law and PrecisionSec’s Privacy Policy.

You should not submit personal data or sensitive information unless you have a lawful basis to do so.
13. Export Control and Sanctions
You may not use the PrecisionSec Transforms in violation of applicable export control, sanctions, or trade compliance laws. You represent that you are not subject to any legal restriction that would prohibit access to or use of the PrecisionSec Transforms.
14. Changes to These Terms
PrecisionSec may update these Terms from time to time. The updated version will become effective when posted, unless otherwise stated. Continued use of the PrecisionSec Transforms after updated Terms are posted constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms shall be submitted to the courts located in Vancouver, British Columbia, unless otherwise required by applicable law or agreed in writing.
